Special Budget Meeting of September 30, 2008

Special Budget Meeting of the Crawford County Board of Commissioners was called to order by Chairman, Dave Stephenson, at 5:03 p.m. in the Crawford County Building, Grayling, Michigan on the 30th day of September, 2008.
Invocation by Commissioner Stephenson.
Pledge of Allegiance led by Commissioner Hanson.
Roll Call: Stephenson, Anderson, Hanson, Lange and Rogers.
Absent – Beardslee and Pinkelman.
Sandra Moore, County Clerk - Present.
Paul Compo, County Controller - Present.
Others present at various times: Kirk Wakefield, Trey Ayers, Don Sommerfeld, Neal Michal, Carol Conklin,and Bob Bonkoski.

Approval of the Agenda

Motion by Lange, second by Rogers, to accept the agenda as presented. Ayes (5) five, nays (0) none, absent (2) two, Motion Carried.

Brief Public Comment

Neal Michal thanked commissioners for their service.

Public Hearing – FY2008/09 Budget Hearing

Motion by Hanson, second by Lange, to open public comment on the agenda. Ayes (5) five, nays (0) none, absent (2) two, Motion Carried.

Chairman Stephenson opened the Hearing for Public Comment.

Incoming Prosecutor Ayers inquired on the salary for the Assistant Prosecutor. Controller Compo advised the salary for the Assistant Prosecutor will be done at the December 17th, 2008 regular board meeting. Commissioner’s explained the process through the audit committee which is done by comparisons with like size counties in population, SEV and workload and the Board felt that $50,000 is a fair salary for someone that has never been an Assistant Prosecutor.

Don Sommerfeld indicated the workload in Crawford has increased and in comparison Kalkaska County has two (2) assistants.

Commissioner Hanson advised the Board reviews statistics of surrounding counties and feels that $50,000 is fair.

Commissioner Pinkelman now present (5:20 p.m.)

Mr. Ayers advised he wants two (2) full time people in the office and indicated there are 700 statutory duties that are quantified and there is a lot of work to be done. Mr. Ayers inquired on the funding for the neglect and abuse cases. The board advised the county plans to capture those funds for the general fund.

Commissioner Lange advised the audit committee reviewed other county salary ranges and in three different graphs a starting wage should be between $40,000 and $45,000.

Chairman Stephenson inquired on what additional revenue streams the Prosecutor can obtain. Mr. Ayers advised he is reviewing seizure laws and if they can apply in Crawford County. Mr. Ayers further advised the abuse and neglect cases range from $3,000 to 11,000.

Neal Michal advised he serves on the Prosecutor’s budget review committee and advised they are reviewing expenses incurred in unnecessary jury trials and they are reviewing an initiative to save money for the county.

Commissioner Pinkelman remarked that there are elected official that don’t receive the compensation that the Assistant Prosecutor receives. Mr. Ayers advised those officials don’t receive life-threatening assaults like the Sheriff or Prosecutor do.

Don Sommerfeld reviewed his past experience for the Board’s consideration and expressed his willingness to serve as the Assistant Prosecutor for Crawford County.

Motion by Hanson, second by Lange, to close the public hearing and resume the special board meeting at 6:03 p.m. Ayes (6) six, nays (0) none, absent (1) one, Motion Carried.

Chairman Stephenson closed the budget hearing and resumed the Special Meeting at 6:03 p.m.

FY2008/09 General Fund Budget

Motion by Hanson, second by Lange, to adopt the FY 2008/09 General Fund Budget in the amount of $5,272,143.00. Roll Call: Anderson – aye, Beardslee – absent, Hanson – aye, Lange – aye, Pinkelman – aye, Rogers – aye, Stephenson – aye, Motion Carried.

FY2008/09 Special Revenue Fund Budget

Motion by Hanson, second by Anderson, to approve the FY2008/09 Special Revenue Funds as presented. Roll Call: Beardslee – absent, Hanson – aye, Lange – aye, Pinkelman – aye, Rogers – aye, Stephenson – aye, Anderson – aye, Motion Carried.

FY2008/09 General Appropriation Act and Budget

Motion by Lange, second by Hanson, to adopt the FY2008/09 General Appropriation Act & Budget Resolution, pursuant to Act 2 PA 1968, as amended. This document covers the General Fund, Special Revenue Funds and all Debt Service Funds, it also complies with the Department of Treasury "Truth in Taxation" requirements. The adopted millage rates for 2008 are as follows:

FY2008/09 Salary Schedule

Motion by Hanson, second by Lange, to accept the FY2008/09 Salary Schedule as presented.

Motion Amended by Lange, second by Hanson, to add two judicial secretaries with a 2.8 percent increase to the FY 2008/09 salary schedule. Roll Call: Lange – aye, Pinkelman – aye, Rogers – aye, Stephenson – aye, Anderson – aye, Beardslee – absent, Hanson - aye, Motion Carried.

FY2008 COA Fund Budget Amendments

Motion by Hanson, second by Lange, to accept the FY2008 Commission on Aging Fund Budget Amendments in the amount of $94.00. Roll Call: Pinkelman – aye, Rogers – aye, Stephenson - aye, Anderson – aye, Beardslee – absent, Hanson – aye, Lange – aye, Motion Carried.

Department Reports

Sheriff Wakefield advised two (2) new patrol cars have just been delivered and all is well within the department.

Unfinished Business – None.

New Business – None.

Any Other Business that May Legally be Conducted - None.

Executive Session

Motion by Lange, second by Rogers, to recess the special budget meeting and enter into an executive session to discuss pending litigation with the 46th Circuit Trial Court (6:17 p.m.) Roll Call: Rogers – aye, Stephenson – aye, Anderson – aye, Beardslee - absent, Hanson – aye, Lange – aye, Pinkelman – aye, Motion Carried.

Executive Session began at 6:17 p.m. and concluded at 6:35 p.m.

Motion by Lange, second by Pinkelman, to accept the September 30, 2008 Executive Session minutes as read. Ayes (6) six, nays (0) none, absent (1) one, Motion Carried,

Stipulation and Order Modifying the July 31st and August 22, 2008 Orders as to the 46th Circuit Trial Court, Crawford County and Kalkaska County

Motion by Lange, second by Hanson , to authorize the Chairman and County Attorney Bonnie Toskey to sign the stipulation and order modifying the July 31st and August 22, 2008 Orders as to the 46th Circuit Trial Court, Crawford County and Kalkaska County. Roll Call: Stephenson – aye, Anderson – aye, Beardslee - absent, Hanson – aye, Lange – aye, Pinkelman – aye, Rogers – aye, Motion Carried.

Controller Compo advised he will be in Traverse City at the MERS conference tomorrow.
